Digital Security & Student Data Privacy

Understanding FERPA and your responsibilities as a substitute

📋 What is FERPA?

The Family Educational Rights and Privacy Act (FERPA) is a federal law protecting the privacy of student education records. As a substitute teacher, YOU are bound by it.

  • Student records are confidential
  • You may not share student info with parents, media, or other students

  • Do not discuss individual students in public spaces or on social media

🚫 FERPA Violations — Real Consequences

  • Violations can result in immediate removal from assignment

  • School district legal liability
  • Potential personal legal consequences

When in doubt, say nothing and refer to administration.

✅ DO

  • Log off any teacher computers when finished
  • Use only school-approved technology
  • Keep student rosters secure and face-down
  • Report any data breach to administration

❌ DON'T

  • Post student names, photos, or work on social media
  • Access student records beyond what's needed
  • Use personal devices to photograph classroom activities
  • Discuss student behavior with other parents

💡 Scenario

A parent approaches you after class and asks how their child is doing. What do you say?

Politely redirect: "I'm the substitute for today. Please contact the main office to speak with your child's teacher or counselor."

INCIDENT MANAGEMENT

Responding to Incidents: What to Do & How to Document

🚨 Identifying & Responding to Behavior Issues

LEVEL 1 — Minor (handle in classroom):
Off-task behavior, talking out of turn, minor disruption Redirect calmly, use proximity, restate expectations
LEVEL 2 — Moderate (document + notify):
Persistent disruption, profanity, disrespect Verbal warning, call school office, document
LEVEL 3 — Serious (escalate immediately):
Fighting, weapons threats, self-harm, drug use Do NOT intervene physically | Call office IMMEDIATELY | Secure other students | Wait for administration
Your job is to CONTAIN and REPORT — not to physically restrain.

📝 Incident Documentation: The 5 W's

  • WHO was involved? (names, roles)
  • WHAT happened? (specific behaviors, words used)
  • WHERE did it occur? (room, hallway, playground)
  • WHEN did it happen? (exact time)
  • WHAT action did YOU take? (steps followed)
Then: "Write your report BEFORE leaving the building. Memory fades quickly."

🔴 Mandatory Reporting — No Exceptions

You are a MANDATED REPORTER as a school employee.

You MUST report if a student discloses or you observe:

  • Physical, emotional, or sexual abuse
  • Neglect or unsafe home conditions
  • Threats of harm to self or others
  • Bullying with physical harm

How: Report to the building principal or school counselor IMMEDIATELY
Then: Contact Kelly Education field support same day

"You cannot delegate this responsibility. Report it."

🤝 De-escalation Techniques

  • Stay calm — lower your voice, slow your speech
  • Give the student space — don't crowd or corner
  • Acknowledge feelings: "I can see you're frustrated"
  • Offer a choice: "You can complete this here or in the hallway with the counselor"
  • Avoid power struggles — you don't need to "win"
  • Never threaten consequences you cannot enforce
  • Remove audience — ask other students to look away or work independently
💬

SCENARIO: A student slams their book and yells 'I hate this class!' — What's your first move?

Answer: Stay calm. Lower your voice. Quietly approach and say: 'I hear you. Let's step into the hallway for a moment.' Then notify the office.
